Anxious World Watches the Countdown to US Election
Governments across the world are anxiously watching the race for the White House, as they prepare for either Republican Donald Trump securing a second term as U.S. president or for an electoral win by his Democratic challenger, former Vice President Joe Biden. Who will be the international winners and losers from Tuesday’s U.S. election? “The last four years have confirmed that the choices the U.S. makes are highly consequential for international politics,” according to a commentary by Britain’s leading foreign policy research group, Chatham House. Chatham House added, “The next president will determine how America’s diplomatic, economic and military resources are invested, and, especially, what value the U.S. will attach to existing alliances and multilateral institutions. Whoever sits in the White House will shape the trajectory of the U.S.–China relationship and the global economy, with significant implications for America’s partners.” And implications for U.S. adversaries. Although some profess to claim the impact might not be as great as some might think. In RussiaRussian experts say they expect little improvement in relations between Moscow and Washington, regardless of who wins. “Putin and people around him might like Trump because he fits very nicely with their view of the world,” according to Andrey Kortunov of the Russian International Affairs Council, a research group based in Moscow, in referencing Russian President Vladimir Putin. Kortunov points to Trump’s skepticism about the importance of multilateral institutions and his more transactional approach to diplomacy. Antagonism, he says, will continue. “Russia’s leaders have long been convinced that any unilateral steps or shifts in Moscow’s foreign policy will be perceived in the West as a sign of weakness, and thus an invitation to crank up the pressure on Russia,” he said. “Russians don’t back down. This principle has remained at the core of Russia’s foreign policy throughout the years.”Former Russian officials over the past few months have also told VOA they expect relations to remain antagonistic with the United States and Europe, blaming what they see as a U.S.-led conspiracy to curb Russian influence. “Some people in the Kremlin hoped it would be different with Donald Trump. But I wasn’t holding my breath,” a former senior Kremlin aide told VOA, describing debates among Russian officials in the run-up to the 2016 U.S. election. Much of the same is happening now, say other former officials. Global interestDespite apparent Russian nonchalance about the result, few in Moscow or elsewhere in the world doubt the enormous global ramifications of Tuesday’s election. A reporter for Britain’s Sky News suggested on air that the world should have a vote in the election because of the international repercussions of the result. This is not just a national election, but a global one, he said. Hundreds of millions around the globe will likely stay up for overnight election watch parties. Others say they will interrupt their work day to keep an eye on the results as they start to unfold. Some cities are planning to broadcast election coverage on billboard-sized televisions. Aside from the fascination with U.S. politics, foreign governments often view the election through the prism of their strategic interests. “Although the U.S. presidency is not as all powerful as many people think, it is certainly, both inside and outside of the U.S., the most powerful elected position in the world. Right now, the world is looking at the U.S. with great anxiety and expectation,” according to Cas Mudde, professor of international affairs at the University of Georgia, writing in Britain’s The Guardian newspaper. Leaders guardedAnxiety is shared by governments at this stage — whether they prefer Trump or Biden. With opinion polls getting their predictions wrong in 2016, no overseas leader can be sure how this election will turn out. Analysts say national leaders most closely associated with Trump, such as Israeli Prime Minister Benjamin Netanyahu and Indian counterpart Narendra Modi, have been cautious in their praise of him, fearing if he loses, their full-throated support of Trump would adversely affect relations with a potential Biden administration. Hungary’s firebrand populist Prime Minister Viktor Orban has been one of the few European leaders to speak out in support of Trump as he was in 2016, announcing in an article in a Hungarian newspaper in September that he’s “rooting for another victory for Donald Trump because we are very familiar with the foreign policy of U.S. Democratic administrations, built as it is on moral imperialism. We have tasted it — albeit under duress. We didn’t like it and we don’t want a second helping.” Other conservative nationalist leaders in central Europe have been quieter, despite sharing Trump’s antipathy toward the European Union and his populist ideology. Poland’s President Andrzej Duda and senior officials of the country’s Law and Justice Party, or PiS, have avoided replying when asked who they prefer. Throughout his term in office, Trump has polled badly in Europe generally, but more so in the west of the continent. Only 13% percent of Germans, 18% of Swedes, and 20% of the French have confidence in him to do the right thing in world affairs, according to a survey at the start of the year by the Pew Research Center. Those percentages are much lower than for Trump’s predecessor, Barack Obama, during his last year in office. Public opinion becomes a little more mixed moving west to east, largely due to approval of Trump by supporters of populist nationalist parties, which are stronger in central Europe and who see the Republican president as an ideological ally, especially when it comes to migration. The Pew poll found a majority of Poles, 51%, had confidence in Trump doing the right thing in world affairs. In Western EuropeThe western European public and governments, by contrast, are eager for a reset from the Trump years, and a return to more predictable and traditional transatlantic relations, analysts say. “Biden has always been a staunch trans-atlanticist — and, over the course of his decades-long political career, he has forged close relationships with key European leaders, including German Chancellor Angela Merkel,” noted Alex Soros in commentary for the European Council on Foreign Relations, an international research institution partly funded by his father, philanthropist George Soros. Biden is a known quantity, having served 34 years in the U.S. Senate and eight as Obama’s vice president. They say they expect him to work as he always has, building up alliances and working on the international front as a multilateralist. His foreign policy would highlight common liberal values with western Europeans, they say. But they do not expect a total restoration of how things were before Trump’s “America First” policy. “Winners” outside Europe in the event Trump secures a second term include Brazilian President Jair Bolsonaro, also a conservative nationalist. Bolsonaro aides say they would fear a change in Washington, adding that Brazil’s leader would be much more isolated internationally if Trump loses. They would expect confrontations with a Biden administration over human rights issues and climate change. In the Middle East, Egypt’s President Abdel Fattah El-Sissi clashed badly with the Obama administration over his government’s human rights record and officials in Cairo say they expect a repeat, if Biden is elected. Likewise, the Gulf monarchies have forged close ties with the Trump administration and were relieved when Trump told Arab leaders during a visit to the Saudi capital of Riyadh in 2017 that, “We are not here to lecture.”

Twitter to Label Tweets with Premature Election Claims
Social media giant Twitter said Monday it will put warning labels on tweets from U.S. election candidates that claim victory ahead of official results. In a blog post Monday, the company said an election win must be “authoritatively called” before tweets without warning labels will be allowed by candidates or campaigns. To determine election results, Twitter said it would require an announcement from state election officials or a “public projection from at least two authoritative national news outlets that make independent election calls,” citing examples that included ABC News, The Associated Press, CNN and Fox News. Tuesday’s U.S. election has a record number of early votes, which election officials say could slow down the vote count in some states. Because of this, it is possible that a winner in the presidential race, along with some state and local races, will not be known on election night. Twitter said candidates’ tweets that include premature claims of an election victory would be subject to warning labels such as, “Official sources called this election differently,” or “Official sources may not have called the race when this was tweeted.” The company said U.S.-based accounts with over 100,000 followers and a significant engagement that post premature claims will also be considered for labeling. In addition, Twitter said any tweets “meant to incite interference” with the election process or with the implementation of election results, including through violent action, will be removed.

В 2020 році Нацполіція почала розслідувати 173 справи про порушення щодо журналістів
У 2020 році Національна поліція України почала розслідувати 173 факти перешкоджання професійної діяльності журналістів. Про це пресслужба Нацполіції повідомила 2 листопада, в Міжнародний день припинення безкарності за злочини проти журналістів.
Заступник міністра внутрішніх справ Антон Геращенко заявив, що Міністерство внутрішніх справ побудувало «тісну співпрацю зі спілкою журналістів України».
Він також нагадав про справу черкаського журналіста Вадима Комарова, який помер після побиття в 2019 році. За словами Геращенка, Головне слідче управління Нацполіції співпрацює з черкаським осередком для пошуку безпосередніх учасників та організаторів нападу на Комарова.
«В цілому ми налагодили роботу таким чином, що керівники обласних управлінь поліції ведуть окремий облік злочинів щодо перешкоджання законних прав журналістів – це, зокрема, 171 стаття Кримінального кодексу України, окремим обліком ведуться всі факти нападів на журналістів. Ми миттєво реагуємо і, я думаю, що за останні півтора року журналістська спільнота бачить, що ми робимо в цьому напрямку», – цитує Геращенка пресслужба Нацполіції.
Як зазначив наступник начальника Головного слідчого управління Нацполіції Степан Довгунь, зі 173 відкритих станом на жовтень у поточному році проваджень 132 стосуються перешкоджання законній професійній діяльності журналістів, 41 – погроз або насильства щодо журналіста.
При цьому до суду направлено обвинувальній акти в дев’яти кримінальних провадженнях за 10 правопорушеннями. З них шість актів стосуються перешкоджання діяльності журналістів, чотири – погроз чи насильства щодо журналітів. Загалом наразі триває досудове розслідування в 211 кримінальних провадженнях щодо злочинів проти працівників медіа.

Крім того, як в Департаменті захисту інтересів суспільства і держави Національної поліції сторили окремий підрозділ для захисту журналістів, заявив голова департамент Євгеній Макаров.
«Для оперативної комунікації із журналістами створено електронну адресу, куди всі представники ЗМІ можуть надавати інформацію про вчинення відносно них будь-яких протиправних дій: dzisd_media@police.gov.ua», – заявляє пресслужба Нацполіції з посиланянм на слова Макарова.
2 листопада посольство США в Україні закликало українську владу встановити справедливість у справах про вбивство журналістів, в тому числі Георгія Гонгадзе та Павла Шеремета.

Посольство США в Україні звинувачує Росію в упередженості щодо кримської адвокатки Гемеджі
Посольство США в Україні вважає, що Росія переслідує кримську адвокатку Лілю Гемеджі через її успіхи в розкритті несправедливості в кримінальних процесах в анексованому Криму. Про це йдеться в заяві дипломатичного відомства в твітері.
«Через успіхи адвоката Гемеджі в розкритті несправедливості в так званих процесах в окупованому Криму Росія штампує проти неї упереджені рішення кримського« суду », щоб усунути її. Юристи з прав людини в Криму повинні мати можливість виконувати свою найважливішу роботу », – йдеться в повідомленні.
Раніше російський Південний окружний військовий суд виніс Гемеджі окрему ухвалу за «багаторазове порушення регламенту судових засідань».
Гемеджі вважає, що ця скарга – це форма тиску на неї як захисниці, яка активно відстоювала позицію свого підзахисного у кримінальній справі. Вона представляла в суді інтереси кримського правозахисника і координатора громадського руху «Кримська солідарність» Сервера Мустафаєва, засудженого 16 вересня 2020 року на 14 років позбавлення волі в колонії суворого режиму. Активіст визнаний Amnesty International в’язнем сумління.

Літо до Покрови і 4 температурних рекорди – метеорологи розповіли, яким видався жовтень у Києві
У Центральній геофізичній обсерваторії імені Бориса Срезневського заявили, що цьогорічний жовтень у Києві став найтеплішим за 140 років спостережень.
«Середньомісячна температура повітря жовтня у Києві склала +12,5°С, що вище за кліматичну норму на 4,4°С. Це забезпечило йому зайняти першу позицію у рейтингу найтепліших з 1881 року. Найтепліше було 4 жовтня, коли максимальна температура повітря після полудня досягла +22,0°С. Найхолодніше було 21 жовтня, коли мінімальна температура під ранок опустилась до +2,5°С. Характерною особливістю цього року у столиці було те, що метеорологічне літо вперше тривало так довго, до 14 жовтня. В жовтні було зафіксовано 4 температурних рекорди», – йдеться в повідомленні.
Крім того, цьогорічний жовтень у столиці відзначився і високими показниками вологості – за місяць випав 101 міліметр опадів, це майже три кліматичні норми.
Раніше в обсерваторії повідомляли, що «бабине літо» у Києві тривало чотири дні, з 22-го до 25 жовтня.

COVID-19 у Києві: влада каже, що лікарні заповнені на 73%
Влада Києва підготувала понад 3100 ліжок для хворих на CJVID-19 і на сьогодні вони заповнені майже на 73 відсотки, повідомила речниця Київського міського голови Віталія Кличка Оксана Зінов’єва.
«На жаль, не зменшується кількість киян, які потребують госпіталізації. Сьогодні в стаціонарах медзакладів міста лікуються 1990 хворих на коронавірус. Із них 39 дітей. У важкому стані перебувають 504 пацієнти. Кисневу підтримку отримують 784 людини. Під апаратами ШВЛ – 22 хворих. Іще 401 пацієнт – у лікарнях із підозрою на коронавірус», – розповіла Зінов’єва.
Раніше сьогодні мер Києва Віталій Кличко оцінив як «справді, складну» ситуацію з COVID-19 у Києві. За його словами, запровадження суворого карантину в столиці буде «крайнім заходом», але виходячи із того, як розвиватиметься ситуація, міська влада буде змушена виконувати рішення уряду, якщо той запровадить жорсткі обмеження.
Станом на 2 листопада у Києві з початку епідемії зафіксували 38 745 випадків COVID-19, одужали 12 924 людини, померли 787.
В Україні виявлено понад 4027 тисячі інфікованих коронавірусом, померли 7 375 людей, одужали понад 163 тисячі.

Gender Gap Seen in US Youth Vote
Since the 2016 presidential election, more than 15 million people have turned 18, making young people a critical voter bloc for the 2020 presidential elections this November. Like their elders, the youth vote is not a monolith or a unified voting bloc that aligns on all issues and demographics. Gender, like race, will impact youth voting in its own way. Among millennial voters, born between 1981-1996, women were more likely to identify with or lean toward the Democratic Party, according to the Pew Research Center. Pew reported that 60% of millennial women associated with the Democratic Party while 31% associated with the Republican, or GOP. For millennial men, the gap was much smaller, with 48% associating with the Democratic Party and 44% associating with the GOP. “Gender issues have been a big consideration for me, specifically just in regard to communicating with people of another gender,” said Christian Lohrenz, a senior at Minnesota State University at Mankato. “LGBTQ rights, equality, those are big deal to me,” Lohrenz said. “You look at the ban on transgender people being in the military, those are certainly things that I disagreed with and I was cognizant of when I was picking my candidate.” Lohrenz said he will be voting for Biden because he agrees with the ideas the Biden campaign put forth for education, criminal justice reform, and climate change. For young women ages 18-29, 60% polled say they intend to vote for Joe Biden, according to data from the Center for Information and Research on Civic Learning and Engagement (CIRCLE) at Tufts University in Medford, Massachusetts.CIRCLE’s 2020 pre-election youth poll also shows that young women of color support Joe Biden, with 77% of young Asian women, 71% of young Black women and 61% of young Latinas intending to vote for Biden. However, this does not mean they approve of the Democratic presidential nominee, as the polling asks. Only 30% of young women of color approve or strongly approve of Biden. On the other hand, 81% of young women disapprove of President Donald Trump. Among young women of color, the percentage is higher, with 94% of young Asian women, 88% of young Latinas, and 85% of young Black women. “I’m voting for Joe Biden because I don’t agree with Trump at all with some of his policies and the way he treats people,” said Jenna Peterson, a junior at Minnesota State University at Mankato. “Is Biden perfect? No. But he is the better option, and he wants to fight for the policies that I believe in such as reproductive health, women’s rights and climate change.” Kaylee Corvin, a sophomore at the University of Virginia, says that while she doesn’t always agree with Trump as a person, she will be voting for him because he aligns best with her political views. “Being able to defend yourself with a firearm: I think that this goes down to really be able to protect yourself and stand up for yourself than rely on the government. I think that’s a huge thing for women empowerment,” she said. “For reproductive issues, I stand a bit more on the pro-life side. But it’s definitely more pro-birth control, pro-access to sexual education, and better access to adoption and funding programs to support mothers,” Corvin added. Grace Leto, a junior at Embry-Riddle Aeronautical University in Prescott, Arizona, said she, too, favors the Trump/Pence ticket. “I voted for [Trump] because I strongly believe that he is the best candidate. He has strengthened our economy so much these past four years, is bold in his actions, and treasures/respects the mission of the military,” she said. “Trump is not the best with words. He has said some comments before that are pretty sexist and I really don’t know what he has done in depth for women’s rights. I do know the recent appointment of the new Supreme Court justice is female, and he especially wanted to keep a woman in the Supreme Court,” Leto said. The recent confirmation of Justice Amy Coney Barrett to the United States Supreme Court, eight days before the presidential elections, has also highlighted gender issues in the minds of many young voters. “With Amy Coney Barrett becoming the new Supreme Court Justice, I’m definitely concerned about my health care and my rights. She’s had a history of not being for abortion and the Affordable Care Act, and she’s Trump-appointed,” said Shruti Nallappa, a master’s student at George Washington University. Nallappa said she will vote for Joe Biden. Barrett is on record as disagreeing with abortion, as well as the Affordable Care Act. But some view it as a success for women’s representation. “Honestly, I’m a little confused from where all the hate comes from. A lot of times people talk about empowering women and this is an example of an extremely successful, strong woman,” said Trevor McDowell, a student at Embry-Riddle Aeronautical University in Prescott, Arizona.This Voter Group Could Sway 2020 ElectionWhile youth vote is predicted to have a significant impact, young white males may play an outsized role in determining the outcomeMcDowell says he will vote for Trump because of his strong support of the Second Amendment, Trump’s economic policies, and because he believes there is a “much deeper corruption” in career politicians. Overall, Democratic presidential nominee Joe Biden has more support from women than men with 56% of women and 50% of men leaning Biden, according to the Pew Research Center. President Trump sees more support from men than women with 48% of men and 42% of women supporting Trump or leaning Trump.

МОН продовжило терміни зарахування іноземців до закладів вищої освіти в Україні
У Міністерстві освіти і науки повідомили, що через карантинні обмеження та епідемічну ситуацію відомство продовжило терміни зарахування іноземців до закладів вищої освіти України у 2020/2021 навчальному році двічі на рік: до 15 грудня 2020 року та 15 квітня 2021 року.
«Також надається можливість для іноземців навчатися за дистанційною формою, за винятком спеціальностей галузі знань «22. Охорона здоров’я», – йдеться в повідомленні.
Повідомляється, що наказ про зміни до Порядку організації набору та навчання (стажування) іноземців та осіб без громадянства вже опублікований в офіційній пресі.

Новий наклад книжки Вахтанга Кіпіані «Справа Василя Стуса», яку вимагав заборонити проросійський політик Віктор Медведчук, вже надійшов на склад і пакується для відправки у книгарні та прямим покупцям. Незабаром книжка буде доступною, про це видавництво Vivat повідомило в ексклюзивному коментарі Радіо Свобода.
«Вони тільки 2 листопада зранку приїхали, зараз пакує склад, у процесі. Ви ж розумієте, як це відбувається: книжки треба на склад доставити, потім склад робить відправку по наших партнерах і по клієнтах, які замовили в нашому інтернет-магазині. Тому з сьомої ранку, може навіть раніше, у нас активно пакують замовлення», – повідомили у видавництві.
У видавництві Vivat повідомляли, що новий наклад складе 15 тисяч примірників. Окрім того, книга незабаром буде доступна в аудіоформаті – її озвучить український режисер і актор кримськотатарського походження Ахтем Сеітаблаєв.
Раніше було вже надруковано майже 20 тисяч примірників. Цей наклад повністю розкупили в день оголошення Дарницьким судом рішення про заборону.
Дарницький районний суд 19 жовтня ухвалив рішення, яким частково задовольнив позов народного депутата від «Опозиційної платформи – За життя» Віктора Медведчука проти журналіста й історика Вахтанга Кіпіані та видавництва Vivat про заборону видання і поширення книги «Справа Василя Стуса».
В Офісі президента України заявили, що «взяли до відома» рішення Дарницького суду щодо книжки Вахтанга Кіпіані. І наголосили, що «цензура в Україні прямо та недвозначно заборонена Конституцією. У будь-яких проявах».
У вересні 2019 року Віктор Медведчук заявив, що просить суд заборонити книжку журналіста й історика Вахтанга Кіпіані про «Справа Василя Стуса», бо та містить «висловлювання, які не відповідають дійсності». Сам журналіст назвав позов тиском на свободу слова.
Віктор Медведчук був державним захисником українського поета Василя Стуса. Його часто звинувачують у порушенні адвокатської етики під час цього процесу. Сам він своєї провини не визнає.
Книга Вахтанга Кіпіані «Справа Василя Стуса» вийшла друком у травні 2019 року.

FBI Probing Trump Caravan Confrontation with Biden Campaign Bus in Texas
The FBI said on Sunday it was investigating an incident in which a convoy of vehicles flying flags in support of President Donald Trump’s reelection bid surrounded a bus carrying campaign staff for Democratic challenger Joe Biden on a Texas highway. Friday’s incident — captured on video that was retweeted by Trump on Saturday with the message, “I LOVE TEXAS!” — prompted the Biden campaign to cancel at least two of its Texas events as Democrats accused the president of encouraging supporters to engage in acts of intimidation. Video footage showed a swarm of pickups and SUVs bearing pro-Trump flags surrounding the Biden campaign bus as it traveled north along Interstate 35 between San Antonio and Austin. The Biden campaign said the Trump caravan tried to force the bus to slow down and to run it off the road. One video clip aired on CNN showed a Trump-flagged pickup swerve into the side of another vehicle traveling with the bus. The Texas Tribune newspaper reported that the sideswiped vehicle was being driven by a Biden campaign staffer. According to the Biden campaign, staff aboard the bus called emergency-911 to report the incident, and local law enforcement responded to the calls and assisted the bus in reaching its destination. “FBI San Antonio is aware of the incident and investigating,” special agent Michelle Lee, a spokeswoman for the Federal Bureau of Investigation in San Antonio, told Reuters in an email. “No further information is available at this time.” On Twitter Sunday night, Trump criticized the FBI investigation of his supporters, writing: “In my opinion, these patriots did nothing wrong.” During a campaign stop in Michigan earlier in the day, Trump said: “Did you see our people yesterday? They were protecting his bus.” Speaking about the incident on the campaign trail Sunday in Philadelphia, Biden said: “We’ve never had anything like this. At least we’ve never had a president who thinks it’s a good thing.” Neither Biden nor his running mate, Senator Kamala Harris, was aboard the bus. The Texas Tribune reported that its passengers included Democratic U.S. House of Representatives candidate and former Texas state Senator Wendy Davis. «У нас навіть більше, ніж півтори тисячі «довічників» в Україні. Утримання кожного з них – це не менше ніж 10 тисяч гривень на місяць. Ми їх харчуємо, охороняємо, забезпечуємо проживанням. Я розумію, що все це поганенької якості, але менше з тим. Фінансування йде і ресурси витрачаються. І це відбувається не 10 років, не 20 років, а поки людина не помре. Відповідно їхня кількість збільшується постійно», – повідомив Денис Малюська.
Він висловив переконаність, що особи, які відбувають довічне покарання, обов’язково мають займатися трудовою діяльністю.
«Якщо хтось вважає, що вони не повинні працювати, а вони повинні дивитися у стелю і «насолоджуватися життям», а потім врешті-решт на якомусь етапі у глибокій старості померти, то це неправильно», – сказав міністр про ідею для «довічників» частково себе утримувати, працюючи.

У Львові відзначають річницю Листопадового чину. Відтворили театралізоване дійство подій 1918 року
На площі Ринок у Львові 1 листопада громадська організація «Товариство пошуку жертв війни «Пам’ять»» традиційно організувала театралізоване військово-історичне дійство «Проголошення Західної Української Народної Республіки» і «Бої за столицю – Львів».
Реконструктори одягнулися у військові однострої, цивільне вбрання початку ХХ століття. Учасники акції роздавали глядачам звернення Української національної ради до галичан про проголошення Західноукраїнської Народної Республіки, розповідали про події Листопадового чину.
Також на площі Ринок відтворили епізод боїв між українськими та польськими вояками, які були в листопаді 1918 року.
Театралізоване дійство має просвітницьку мету, щоб нагадати львів’янам про події, які відіграли важливу роль в українській історії, про одну з героїчних сторінок українців, зауважили організатори заходу.
Листопадовий чин чи зрив, як називають цю історичну подію, відбувся у ніч із 31 жовтня на 1 листопада 1918 року, коли влада в місті перейшла до українців, січові стрільці захопили всі важливі адміністративні будівлі та військові склади, на які вивісили українські прапори. Серед цих будівель були Галицький крайовий сейм і магістрат, пошта, вокзал, цитадель.
Цьому передувало 19 жовтня 1918 року, коли українці проголосили, що будуть створювати свою державу в межах Австро-Угорської імперії.
9–13 листопада проголошується Західноукраїнська Народна Республіка. Українське військо, щоб уникнути оточення, покинуло Львів у ніч на 22 листопада 1918 року, але бої тривали на околицях. Сили між українськими і полсьькими військами були нерівні, коли підійшли регулярні підрозділи з Малопольщі, Кракова, Великопольщі. Сьогодні, у річницю проголошення ЗУНР у Львові на Личаківському і Янівському цвинтарях відбулися панахиди біля могил українських січових стрільців і вояків Української Галицької армії. На Личакові поховані вояки УГА, Дмитро Вітовський – держсекретар військових справ ЗУНР, Олександр Тисовський – засновник «Пласту», Михайло Галущинський – комендант легіону Українських Січових Стрільців, Євген Петрушевич – Президент Національної Ради ЗУНР.
На Личаківському цвинтарі спочивають і польські вояки, які загинули обороняючи Львів у 1918–1919 роках. Сюди традиційно 1 листопада приходять представники польських товариств і запалюють лампадки.

Why a Big Boost in Litigation Is Possible After Tuesday’s Election
With Tuesday’s U.S. presidential election upon us, it is far from certain that either President Donald Trump or his Democratic rival, former Vice President Joe Biden, will emerge as the clear winner on election night.While Biden is leading Trump by a cumulative average of 8 percentage points in national polling, the Democrat’s lead shrinks to just a few points in a number of battleground states crucial to determining the winner in America’s unique system of indirect presidential election.This has raised the odds that the election results could be delayed until all the ballots are officially tallied and certified. To be sure, a winner could well be declared if either Trump or Biden comes out on top with a large margin of votes.But if the results are too close to call in some states, the ballots there could be subject to a recount and potential legal challenges, a process that could take weeks, if not longer, to sort out.“There’s nothing magical about Election Day or election night in terms of the legal requirements of finding out who won,” said James Gardner, a law professor and election law expert at the University of Buffalo. “What you have to do is go through the complete electoral process and count all the votes. And (if) that takes a few days or more, then we just wait.”Tom Spencer, a veteran Republican election lawyer and vice president of the Lawyers Defense Fund, agrees that the impending electoral contest won’t be over until all the ballots are counted.“I think that experienced election lawyers know that results change predicated upon when the ballots come in,” said Spencer, who served as co-counsel for the George W. Bush presidential ticket during the 2000 vote recount in Florida.Hundreds of lawsuitsFor American voters, this has been a year of confusion as Republican and Democratic lawyers have filed hundreds of lawsuits over voting by mail and other rules during the pandemic, making this election cycle the most litigated in history.With the looming possibility that the presidential election outcome could be decided in the courts rather than at the ballot box, both the Trump and Biden campaigns have enlisted high-powered lawyers who have already begun running through various post-election scenarios.“We have been planning for any post-election litigation and recounts for well over a year and are extraordinarily well-positioned,” Justin Riemer, chief counsel for the Republican National Committee, said in a statement to VOA. “With the help of our national network of attorneys, the RNC has been beating the Democrats in court for the last several months and that will continue should they attempt to sue their way to victory in November.”A Biden campaign spokesperson did not respond to a request for comment. In an Oct. 9 tweet, Democratic lawyer Marc Elias wrote, “Republicans are spending $20 million to make voting more difficult in the middle of a pandemic that has cost over 200,000 lives.”If any of the election results for president, members of Congress or state offices are close, losing candidates have two “remedies” available to them, Gardner said.The first is a vote recount. Currently, 21 states allow for automatic recounts if the margin between the two opposing candidates is less than 1%, according to the National Conference of State Legislatures. In other states, a losing candidate can request a recount.A recount “simply repeats, with greater care, the counting of ballots that were in the initial pool of ballots,” Gardner said.If a recount does not change the results – they rarely do – the losing candidate can launch what is known as an election contest, essentially filing a legal challenge, Gardner said. This is the phase where the losing candidate can dispute the validity of ballots or practices used in counting the votes, triggering court battles that could take weeks and potentially end up before the U.S. Supreme Court.State and federal courts all the way up to the Supreme Court have been busy for months dealing with more than 300 cases stemming from the primary and general election campaign – many of them having to do with mail-in voting and changes in procedures at polling places in response to the coronavirus pandemic.This week, the Supreme Court allowed election officials in the battleground states of Pennsylvania and North Carolina to accept mail-in ballots that arrive three to six days after the election, respectively, after refusing to affirm Wisconsin’s six-day ballot receipt extension.“You could very well have a situation like we had in 2000 with ballot examination and counting teams going through thousands of ballots with observers from both parties looking over their shoulders,” Gardner said.Late-arriving ballotsOne potential area of post-election dispute will likely involve mail-in ballots that arrive after Election Day, said Sylvia Albert, director of voting and elections at Common Cause, a citizen advocacy organization.As of Friday, there were still many millions of outstanding mail-in ballots. That means ballots that arrive after Election Day may not count in some states.In Pennsylvania and Minnesota, two battleground states that accept mail-in ballots after Election Day, election officials will segregate late-arriving paper votes. How to dispose of those ballots could become the main issue in subsequent court cases. North Carolina, another key state, may do the same, Albert said.“I think there will be an attempt to segregate those ballots to possibly have them thrown out,” Albert said.Rejected mail-in ballotsRejected mail-in ballots could become another focus of any post-election litigation.During every U.S. presidential election, hundreds of thousands of mail-in ballots are discarded by election officials for a variety of reasons, from arriving after the deadline to missing a proper signature on the outer envelope.But this year, because of the ramp-up in absentee voting, a lot more ballots face rejection, with minority and first-time voters disproportionately affected, according to experts. In North Carolina and Florida, respectively, more than 10,000 and 15,000 ballots face rejection.Although voters in 30 states including Florida are given an opportunity to “cure” or correct problems with their ballots, voters in 20 other states are not afforded that opportunity. That means election officials can toss ballots without informing voters about the defects.“I think there will be large disagreements and lots of wrangling over which of those ballots should count and which of the absentee voters should be able to correct any errors in their ballots,” Albert said.Ballot drop boxesBallots placed in drop boxes across the country are another category of voting facing potential litigation.While some states have long used free-standing boxes to collect ballots, this year 40 states will use them, according to the Stanford-MIT Healthy Elections Project.The expanded use of drop boxes has become a major flashpoint in the debate over voting access during the pandemic and a focus of litigation in at least three states: Ohio, Pennsylvania and Texas.While Democrats and voting rights advocates say drop boxes make it easier for voters to cast their ballots without exposing themselves to the virus, President Trump and Republicans have railed against them, describing them as a potential ballot security risks and trying to limit their number. In Texas, for example, Gov. Greg Abbott has limited the number of drop boxes to one per county.While election officials have sought to reassure voters regarding the security of drop boxes, Republicans continue to argue that they pose problems. In Texas, litigation continues over whether ballots dropped in a collection box were secure enough to be counted, Albert, of Common Cause, said.“I think there are going be arguments that drop boxes were not secure and therefore none of the ballots should count,” she said.

In response to increased social media messages on how, where and when to vote in the U.S. general election, voters are posting proof that they cast their ballots.Whether it is a photo of the ballot showing who someone voted for, or a selfie of the voter, an increase in mail-in and early voting amid the pandemic means more voters are posting their ballot selfies the week ahead of the election.Whether these photos are legally allowed differs by state.According to data from Ballotpedia, as of September, 25 states and the District of Columbia allow ballot selfies — photos of a completed ballot or a picture of a voter inside the polling place.Because the popularity of ballot selfies rose in the past decade, most state laws govern whether photos can be taken inside polling places. But there are no clear rules on whether an absentee ballot can be photographed.In West Virginia, Texas, Tennessee, Delaware and Arizona, photography and/or cellphones are banned at polling places. In 2016, pop star Justin Timberlake deleted a photo of himself casting his vote in Tennessee after learning it was prohibited by a 2015 state law.In Maryland and Iowa, rules banning photography in polling places specifically state that photos of mail-in ballots are allowed.But many states argue that photography of a ballot or in a voting place violates the promise of a “secret ballot.”The secret ballot has long been perceived as an integral part of the U.S. democratic system, protecting voters from criticism or peer pressure and allowing them to fulfill their democratic privilege in private.Additionally, some states have argued that documentation of ballots could promote an uptick in voter fraud and buying votes — allowing companies or individuals to force paid voters to give confirmation that they completed their vote.In 2014, New Hampshire banned photos of ballots, citing the potential of vote-buying or influence. US: Iranian Hackers Behind Threatening Emails Accessed Voter Data
U.S. officials said late Friday that the Iranian hackers behind a wave of threatening emails sent to thousands of Americans earlier this month successfully accessed voter data.The statement, issued jointly by the FBI and the Department of Homeland Security’s Cybersecurity and Infrastructure Security Agency (CISA), partially confirms the authenticity of a video distributed as part of a disinformation campaign that briefly drew attention when it became public last week.The campaign, which consisted of thousands of threatening emails sent to random U.S. voters in the name of a pro-Trump far-right group, featured a video in which a hacker purported to demonstrate how they could cause havoc by breaking into voter registration records.Experts who examined the footage said it amounted to little more than an attempt to scare voters about the integrity of the Nov. 3 contest, but the question of whether the hackers actually did break in anywhere had gone unanswered until now.CISA and the FBI confirmed Friday that “the actor successfully obtained voter registration data in at least one state.”The state was not identified, although purported personal details of Alaska voters were briefly flashed on the video. The FBI, CISA and the Alaska Division of Elections did not immediately return messages seeking comment. ДБР заявляє про затримання високопосадовця Державної фіскальної служби за хабар
Оперативники Державного бюро розслідувань затримали керівника Головного управління протидії економічним правопорушенням ДФС України за спробу отримати частину хабаря в 200 тисяч доларів – про це пресслужба ДБР повідомила 29 жовтня.
Як зазначають у бюро, затримання відбулося, коли посадовець ДФС отримував половину суми.
«За попередньою інформацією, посадовець вимагав від керівника одного з фармпідприємств 200 000 доларів США за повернення вилучених під час обшуку документів та закриття кримінального провадження», – йдеться в заяві.
Ім’я затриманого ДБР офіційно не повідомляє.
Досудовим розслідуванням у кримінальному провадженні керує Офіс генерального прокурора.
У Державній фіскальній службі поки що публічно не коментували заяви про затримання.

165 людей перетнули лінію розмежування на Донбасі через контрольно-пропускний пункт «Станиця Луганська». Про це в ефірі Радіо Донбас.Реалії повідомив пресофіцер Державної прикордонної служби України у складі Операції об’єднаних сил Ігор Лизогуб. За його словами, людей пропустили згідно з окремим рішенням командувача ООС.
«Командувачем було прийнято рішення щодо пропуску людей, які мають реєстрацію на тимчасово окупованій території. Від моменту прийняття рішення 655 чоловік прослідувало в бік окупованого Луганська. Зокрема, сьогодні, станом на 16:45 165 чоловік також змогли пройти в бік ОРДЛО», – зазначив речник.

Громадяни можуть перетинати лінію розмежування в Станиці Луганській лише за окремим рішенням командувача української воєнної Операції об’єднаних сил. Таке рішення може бути ухвалене, «виходячи з документально підтверджених життєво важливих обставин соціально-гуманітарного характеру».

Trump Tests Limits as Cabinet Members Fan Out to Key States
Education Secretary Betsy DeVos planned a “Moms for Trump” rally in her home state of Michigan. The Department of Homeland Security’s top official was in Texas to celebrate completion of a section of the U.S.-Mexico border wall. The chief of the Environmental Protection Agency headed to North Carolina after visiting Georgia the day before.
That was just Thursday.
Members of President Donald Trump’s Cabinet are logging extra miles as mostly unofficial campaign surrogates in crucial states in the final days before Tuesday’s election, blending politics and policy in ways that critics say skirt established norms and may even violate the law.
It’s long been one of the benefits of incumbency that a president can enlist his Cabinet to promote administration accomplishments. But only to a point, with a law on the books since 1939 requiring a division between political and official activities for all federal employees except the president and vice president.
“The Trump administration has completely obliterated that line,” said Austin Evers, executive director of American Oversight, which describes itself as a nonpartisan watchdog organization. “The White House is now the seat of government, where the president lives, and one of his chief campaign props. And that erosion of norms has spread throughout the entire administration.”
This criticism isn’t new, but it’s intensified in recent months. The administration, which came under fire for using the White House as a backdrop for the president’s acceptance speech at the Republican National Convention, insists it is adhering to the law known as the Hatch Act.
“The Trump administration takes the Hatch Act seriously and all events are conducted in compliance with the law,” White House spokesman Judd Deere said.
But already, at least one member of the administration has run afoul of the decades-old law in recent weeks.
The Office of Special Counsel, led by a Trump appointee, concluded this month that Agriculture Secretary Sonny Perdue violated the law at a North Carolina event in August where his remarks in support of the president devolved into crowd chants of “four more years.” Perdue was ordered to reimburse the government for costs associated with the trip.

Two New York Democrats, Reps. Eliot L. Engel and Rep. Nita Lowey, said this week that the same office was investigating the speech that America’s top diplomat made to the GOP convention from Israel. The office declined comment and the State Department noted that a previous Hatch Act complaint against Pompeo was dismissed.
That Pompeo speech was among a number of appearances, including one in September in Wisconsin, that appeared to many observers to cast aside a long tradition of avoiding partisan politics by secretaries of state. But he’s hardly alone, and the examples have proliferated in recent days.
Energy Secretary Dan Brouillette this week was visiting southwestern Pennsylvania — a swing area in one of the most important battleground states — for at least the third time since August. In an area closely tied to fracking, Brouillette didn’t mention Democratic presidential nominee Joe Biden by name but warned that efforts to develop renewable energy to address climate change could threaten “every form of energy besides renewables.”
Environmental Protection Agency chief Andrew Wheeler has made repeated trips to closely contested Michigan, including one to announce $2 million in grant funding, where he criticized the Obama administration’s response to the lead contamination crisis in Flint.
DeVos has made frequent visits to pivotal states such as Florida, Texas and Wisconsin, for discussions of efforts to reopen schools closed by the coronavirus pandemic and to promote school choice, an issue that Trump has focused on in hopes of appealing to Black voters. Veterans Affairs Secretary Robert Wilkie has traveled to a host of presidential and Senate battleground states in recent months, mixing in dedication ceremonies and other official business with a “fireside chat” and praise of vulnerable GOP incumbents. His activity has received criticism from congressional Democrats.
Other examples include national security adviser Robert O’Brien traveling to Minnesota and Wisconsin this month to discuss trade; senior Trump adviser Stephen Miller holding a conference call Wednesday with reporters and speaking “in his personal capacity” to discuss immigration policy; and Kayleigh McEnany doing double duty as White House press secretary and “Trump 2020 campaign adviser,” as she was described in an appearance on “Fox & Friends” on Thursday.
Hatch Act violations can be referred to the Justice Department for a criminal investigation, but more typically result in administrative penalties. Evers, a former litigator and government lawyer, said lower-level staff should be concerned about the possible legal consequences of working on barely concealed political missions.
There could be electoral consequences as well. “The political calculations that go into these decisions could be very wrong,” he said. “It should matter to the public that their apolitical government is being used for purely partisan ends. So, it may not have the payoff they expect.”

Голова КСУ Тупицький відреагував на розслідування «Схем» щодо придбання землі в окупованому Криму
Голова Конституційного суду Олександр Тупицький підтвердив інформацію, оприлюднену журналістами програми «Схеми», про те, що він не задекларував землю в Криму, власником якої став після анексії за законами Росії.
«Коли я прочитав матеріал, я сам по собі подякував їм за об’єктивність», – заявив Тупицький.
За словами Тупицького, правочин відбувся у 2018 році. «Чого я не вніс його в реєстр? Я до цього часу не знаю, як це зробити. Я не визнаю Крим російським, – заявив він. – Єдина, напевно, моя провина, що я не звернувся до органів НАЗК, щоб вони мені роз’яснили, як це мені зробити».
Журналісти на брифінгу запитали голову КС, чи не вбачає він проблеми у тому, що оформив землю в Криму за законами Російської Федерації, чим фактично визнав її юрисдикцію в Криму.
«Ні, нічого не вбачаю», – відповів Тупицький. І додав: «А що мені потрібно було робити? Подумайте вдома, потім зустрінемось».
Голова КСУ також зауважив: «Давайте говорити так: є постанова – десь Кабміну чи… – що не визнає Україна правочинів, здійснених на території Криму. Але навіть, якщо це так, скажімо, якщо це конституційно, то просто Україна не визнає – цей правочин нікчемний сам по собі. Але це не кримінал. Він просто не визнається».
Окремо він розповів про те, що проти нього в РФ введені економічні санкції та розпочате кримінальне провадження.
Загалом Тупицький підкреслив: «Я готовий відповідати, якщо десь помилки якісь я допустив, то я готовий їх виправляти. Ми ж живемо у цивілізованому світі. Якщо помилки, які порушують закон, то за них також треба нести відповідальність. Це аксіома».
При цьому для українських посадовців законодавчо встановлені обмеження «на взаємодію з незаконними органами, створеними на тимчасово окупованій території», пояснює юрист, член Громадської ради доброчесності Роман Маселко.
«Суддя не має права вступати у будь-які відносини з окупаційною владою. Адже є стаття 9 Закону України «Про забезпечення прав і свобод громадян та правовий режим на тимчасово окупованій території України», і він як представник судової влади повинен дотримуватись позиції, що ці органи незаконні і купувати там якесь майно означає визнання їх легітимності», – розповів Роман Маселко. І
Юрист додає: «Окрім того, відповідно до Кодексу суддівської етики, суддя зобов’язаний і у професійному, і у особистому житті демонструвати поведінку, яка підтримує довіру до судів та утримуватись від дій, які можуть завдати шкоди авторитету правосуддя. Очевидно, що придбання у 2018 році майна в Криму за законодавством окупантів є негідним вчинком для судді Конституційного суду, а отже, містить ознаки проступку, несумісного зі статусом судді. За таке його можна звільнити, правда, це може зробити лише Конституційний суд двома третинами голосів».
Юрист, який спеціалізується на питаннях прав людини у Криму Сергій Заєць пояснює, що закони України вимагають оформлення таких правочинів за законодавством України на материковій частині України.
«Не дотримавшись вимог закону України про окуповані території, який вимагає оформлення цього правочину згідно з вимогами законодавства України на материковій частині України, він уникає вимог про декларування істотної зміни майнового стану, хоча фактично майновий стан покращився. Цим самим він надсилає суспільству меседж, що не дотримуватися приписів – це нормально. Бо якби правочин було укладено відповідно до законодавства України, то майно мало б бути задекларованим», – каже Сергій Заєць.
Раніше журналісти програми «Схеми» розповіли, що голова Конституційного суду Олександр Тупицький у 2018 році став власником земельної ділянки у селищі Кореїз Автономної республіки Крим, оформивши договір купівлі-продажу за російським законодавством, але не відобразив інформацію про це у своїй декларації про майно та доходи. При цьому під головуванням Тупицького судді КСУ 27 жовтня проголосували за визнання неконституційною статті про кримінальну відповідальність за декларування недостовірної інформації і скасували її.
Олександр Тупицький ще до анексії Криму Росією в 2014 році володів маєтком та землею під ним у Кореїзі неподалік Ялти. Але у 2018 році він розширив свої володіння, оформивши ще одну ділянку біля будинку у свою власність. Про це свідчить офіційний документ, отриманий «Схемами» з Єдиного держреєстру нерухомості Російської Федерації. У липні 2018 року Олександр Тупицький (на той момент він був заступником голови КСУ) оформив договір купівлі землі площею 126 кв. м. у громадянина Росії Володимира Рисятова. У деклараціях Тупицького ані за 2018 рік, ані за 2019 рік немає згадки про те, що він став власником ще одного об’єкту нерухомості.
Подання суб’єктом декларування завідомо недостовірних відомостей у декларації – це порушення, визначене статтею 366-1 Кримінального кодексу України. Саме цю статтю 27 жовтня Конституційний суд України на чолі з Олександром Тупицьким визнав такою, яка не відповідає Конституції України.
Окрім того, договір купівлі-продажу землі у Криму Тупицький оформив за законодавством Російської Федерації, його засвідчила Федеральна служба державної реєстрації, кадастру і картографії Росії.
«Схеми» розшукали продавця ділянки. Володимир Рисятов повідомив, що Олександр Тупицький його сусід у Кореїзі – їхні вілли розташовані поруч. «Неправильно були розмежовані ділянки», – розповів Рисятов. І пояснив, що вони з Тупицьким домовились оформити угоду купівлі-продажу за російським законодавством, хоча по факту «продажу не було».
«Там ніякого продажу, нічого там не було. Продаж-то ми оформили договором, але ця земля була не моя. Ось так я скажу», – розповів він.
При цьому юристи пояснюють, що якщо суддя отримав у свою власність землю від іншої особи безкоштовно, за антикорупційним законодавством це може трактуватись як незаконний подарунок.
«Обов’язковою умовою договору купівлі-продажу є сплата покупцем ціни за отриманий товар. Якщо ж земля суддею отримана безоплатно – то в розумінні антикорупційного законодавства безоплатне одержання майна є подарунком. Судді заборонено отримувати подарунки від третіх осіб. За це передбачена адміністративна відповідальність», – розповів Сергій Миткалик, виконавчий директор ГО «Антикорупційний штаб» та заступник голови громадської ради при НАЗК.
При цьому, за даними директора агентства нерухомості «Статус» (Ялта) Едуарда Кісса, ринкова вартість однієї сотки землі у Кореїзі коливається від $5 тис до $15 тис.
«Схеми» звернулися до голови КСУ з проханням надати коментар щодо його майна. У пресслужбі КСУ заявили, що «усі відомості про майно, яке є у володінні та користуванні голови КСУ Олександра Тупицького, містяться у його щорічній декларації».
